The Residential Tenancies (Amendment) (No. 2) Act 2021 commenced on the 11th December 2021.

The new laws brought in are:

  • Rent increases in Rent Pressure Zones are restricted from exceeding general inflation and will be subject to a cap of 2% per year. If inflation is below 2% you will have to go by the lower percentage. If inflation is higher than 2% you are capped at 2% increase.
  • Part 4 tenancies will now have unlimited duration providing security of tenure for tenants. This comes into effect for all new tenancies created on or after 11th June 2022. Existing six year tenancies if not terminated prior to the end of the part 4 tenancy, will become tenancies of indefinite duration.Tenancies can still be terminated under section 34 of the Residential Tenancies Act 2004 as amended including for selling, own use, breach etc.
